Understanding traumatic brain injuries (TBIs) is crucial for trial lawyers who handle personal injury and negligence cases. Knowledge of TBIs can help attorneys effectively communicate the severity, long-term impact, and the complex medical and psychological nuances of these injuries to a judge and jury. Not only that, but a greater understanding of this topic helps lawyers present more compelling cases, cross-examine experts more effectively, and secure better outcomes for their clients.

Lawyers also need to know how federal insurance coverage for brain injuries is changing. In January 2025, the Centers for Medicare and Medicaid Services will recognize traumatic brain injury as a chronic health condition. This inclusion is a critical first step in expanding insurance coverage for the estimated five million Americans living with a brain injury-related disability.

Earlier this year, the Brain Injury Association of America (BIAA) and the United States Brain Injury Alliance united to better support brain injury survivors. Through this powerhouse of advocacy, TBI patients will be better informed about the connections to other neurodegenerative conditions such as Alzheimer’s disease, stroke, Parkinson’s disease, and chronic traumatic encephalopathy.

In this webinar, Maxey ScherrRick Willis, and John Corrigan will present a deeper look into the emerging research and legal implications of these changes. This webinar will discuss:

  • How federal insurance changes may increase public awareness of the long-term effects of brain injury—and affect jury selection
  • New research showing how a TBI can propel permanent changes to an individual’s mental, social, and intellectual characteristics
  • The medical community’s bifurcated classification for symptoms, Pre-TBI and Post-TBI, which can dramatically affect claimant compensation
  • How BIAA is using National Concussion Awareness Day to improve public recognition of the most overlooked brain injury symptoms

A robust network of TBI support will not only allow healthcare providers to connect a patient’s TBI history to a myriad of common symptoms—chronic pain, depression, fatigue, anxiety, and so forth—but also validate the importance of treating TBIs as one would any other chronic health condition. Don’t miss this landmark webinar as it covers the upcoming changes and insights into the medical realities of brain injuries in personal injury practice.
